Profile
VICTIM : İrfan Yılmaz
INCIDENT : The request to postpone the sentence enforcement of a disabled prisoner was rejected on the grounds of “chanting slogans.”
LOCATION : İstanbul, Turkey
SITUATION : He was sentenced to 2 years and 1 month in prison on charges of “making propaganda for an organization.”
Case Summary
İrfan Yılmaz, who has cerebral palsy and a 96 percent disability rate, has not been released despite a report issued by the Forensic Medicine Institute (ATK) stating that he “cannot remain in prison.” Yılmaz, who is wheelchair-dependent and unable to meet his basic needs independently, was denied a request to postpone the enforcement of his sentence by the Administrative and Observation Board. In its latest decision, the Board cited a disciplinary sanction imposed for slogans chanted in prison and an assessment that he was “not of good conduct” as grounds for the decision. Yılmaz’s legal guardian stated that the prison conditions had further deteriorated his health. It was reported that Yılmaz requires constant care and is unable to independently meet basic needs such as eating, personal hygiene, bathing and using the toilet. Because the toilets in the wards are squat toilets, he is unable to use them and uses diapers during the day. His diaper reportedly needs to be changed and washed approximately five times a day. As a result, his fellow prisoners take turns providing his care, with one person largely assisting him with his daily needs each day. Yılmaz had previously requested to be transferred to an open prison institution, but his application was rejected on the grounds that he had not submitted a petition requesting placement in a “separate ward.”
