Case Summary

Erol Boydak has been held in Sincan Prison for approximately three years. Boydak has a 50% hearing loss, and his hearing aid was confiscated by the prison administration. It was reported that the hearing aid was confiscated because it had a Bluetooth function. As a result of the confiscation, Boydak is being forced to live in prison without his hearing aid despite his hearing impairment. Human rights defender and DEM Party Kocaeli MP Ömer Faruk Gergerlioğlu brought the issue before the Grand National Assembly of Türkiye (TBMM). Boydak was prosecuted as part of a case against former executives of Boydak Holding following the events of 15 July 2016. In 2018, the Kayseri 2nd High Criminal Court sentenced him to 7 years and 6 months in prison for “membership in an armed terrorist organisation.” The judgment was upheld by the Ankara Regional Court of Appeal and subsequently by the 3rd Criminal Chamber of the Court of Cassation on 24 January 2023. Boydak has been held in Sincan Prison since October 2023. The confiscation of his hearing aid has been raised as a violation concerning the prisoner’s access to healthcare.
